Продолжение Если ваши отношения не включены в этот список (такие как boyfriend or girlfriend), вы можете получить Peace Order (об этом – ниже). Какие дейтсвия дают мне право на получение этих решений суда? Человек, получающий Protective Order, должен быть жертвой абюза. Закон трактует абьюз как: - дейтсвие, повлекшее за собой физический вред человеку; - действие, внушающее жертве страх, опасние того, что будет причинен физический вред. - оскорбление любой степени; - изнасилование или оскорбление сексуального харакетра, или попытка изнасилования или оскорбления сексуального характера. - преследование (stalking) - насильное удержание кого- либо в каком-лиюо месте против его или ее воли. Каков процесс получения Protective Order? Получение Temporary Protective Order.Для того, чтобы начать процесс получения этого документа, надо подати заявлени на его получение (file a Petition for Protection). Вы можете получить бланк этого заявления at the Civil Clerk’s desk in either the District or Circuit Court в каунти, где живете вы или ваш абьюзер. Ваша местная domestic violence program может помочь вам найти ближайший суд и направлять ваши действия в дальнейшем. Подача такого заявления - бесплатно. После подачи этого заявлния в тот же день будет назначено слушание для получения Temporary Protective Order. Temporary Order вступает в силу сразу по получении. Офицер полиции соообщает о нем абьюзеру (Temporary Order is “served” to your abuser). The Final Protective Order Hearing В течение 7 дней после получения Temporary Order состоится Final Hearing. Жертва должна присутствовать, абьюзер обычно тоже присутствует на слушании со своим адвокатом. Вы тоже можете прийти с адвокатом или с судебным представителем from your local domestic violence program. Когда Суд закрыт: The Interim Protective Order.По новому закону жертва может подавать заявлние на получение Interim Protective Order даже если суд закрыт (ночью, по выходным и в праздники). Такой Order выписывает не судья, а District Court Commissioner. Далее последует слушание в суде, которое должно быть назанчено в течение 2 дней после открытия суда. Interim Order действует до дня назначенного слушания. Имеет ту же силу, что и Temporary Order. Какую защиту я могу получить? Interim and Temporary Order. Судья присуждает “stay-away” или “no contact” orders, что обязывает абьюзера: - прекратить насилия или угрозы по отношению к вам; - прекратить контакты, попытки контактов с вами; - не приближаться в вашей работе, школе или месту жительства; - покинуть дом, гед вы живете; - не приближаться к месту, где находится ваш ребенок (школа, дет.сад). Судья может также: - дать вам временную опеку над вашими детьми: - дать вам право временного использования и владения домом, если вы проживаете совместно с абьюзером. Final Protective Order. - наблюдение полиции; - консультации специалистов; - финансовая помошь и/или - право временного использования или владения автомобилем. Что случится, если Protective Order будет нарушен? Немедленно звоните 911. Полиция обязана арестовать абьюзера. Первое нарушение любого из Order (Interim, Temporary of Final) может повлечь до 90 дней в заключении и/или штраф $1000. Второе и последующие – до 1 года тюрьмы и/или $2500 штраф. Peace Orders Есть несколько отличий от Protective: - Подается заявление на этот Order, если жертва not eligible для Protective Order. - Для его получения вы должны быть жертвой of Abuse, Harassment, Stalking, Trespass, Malicious Destruction of Property. Имеет те же защитные функции. Процесс получения похож на Protective Orders, но имеются различия: - Завяление подается только в District Court; - факт абьюза должен иметь место за 30 дней перед днем подачи заявлние; - подача заявления платная ($30-$50, часть может быть waived); - врем действия – 6 мес. - может быть получен против несовершеннолетнего после первого контакта с Department of Juvenile Justice - не дает права на наблюдение полиции |

Planning can be used while you are still with your abuser, or after the relationship has ended. While still in an abusive relationship, your safety within your home is of primary importance. First, memorize safe numbers including the police, family, or a local domestic violence agency. If possible, obtain a cell phone to keep with you at all times. Your safety plan should recognize dangerous areas within your home, including the kitchen or the garage where weapons are available, or the bathroom and other small places where one might be trapped. If possible, get to a room with a phone or a way to escape. If your friends or neighbors are aware of the situation set up signals or code words either by phone or alternative method that informs them that the situation is violent at home. If you are planning on leaving your home, place an extra set of keys outside or in a hiding space and give extra copies of pertinent documents to someone you trust or place them in a hiding place. If there are children involved in the situation, the school should be notified of possible threats and/or and the current custody situation. Make sure the school knows who the children can be released to and to not give out any information. Vary your route to work and change passwords on bank and e-mail accounts. If you have a restraining order or order of protection, keep it with you at all times. Keep a diary or journal to record harassing e-mails or voice mails, violations of orders, and actual attempts at contact. |

Manipulation Abusers often try to manipulate the "system" by: Threatening to call Child Protective Services or the Department of Human Resources and making actual reports that his partner neglects or abuses the children. Changing lawyers and delaying court hearings to increase his partner's financial hardship. Telling everyone (friends, family, police, etc.) that she is "crazy" and making things up. Using the threat of prosecution to get her to return to him. Telling police she hit him, too. Giving false information about the criminal justice system to confuse his partner or prevent her from acting on her own behalf. Using children as leverage to get and control his victim. Abusers may try to manipulate their partners, especially after a violent episode. He may try to "win" her back in some of these ways: Invoking sympathy from her, her family and friends. Talking about his "difficult childhood". Becoming overly charming, reminding her of the good times they've had. Bringing romantic gifts, flowers, dinner. Crying, begging for forgiveness. Promising it will "never happen again." Promising to get counseling, to change. Abuse gets worse and more frequent over time |

Девочки я вшелторе в Майами написала на него в полицию сфотографировали мой палец синий весь он тоже на меня накатал что то в полицию ко мне приходили на работу оставили документ придти забрать это наверное тоже я не имею права ему звонить писать и приближаться первой Гринки нет что то бесплатного иммиграционного адвоката они мне не дали вообщето предложили но я пошла там только на 12 мая а мой который файлил на АОС запросила за форму 360 850 дол в рассрочку я не знаю что мне с ней делать или ждать там до 12 мая 25 апреля нас двоих вызывают по абьюзу ,если палец был весь синий и сфотографировали его вроде просто сильный ушиб два дня был опухший но большая гиматома была это физический абьюз? А про всякий другой и за шею придушивал и туфли мои ломал и прочее молчу жить низа что тем более с его родителями там папа все ему на ус наматывает шелтор тоже нормальный я русская одна самая молодая ко мн все относятся хорошо подсказывают а самая главная в шелторе пойдет со мной 25 апреля на слушанье.Но все равно мне так все страшно пишите пожалуйста что мне делать что я могу попросить еще из шелтора работаю без разрешения на работу на работе все вроде понимаюм менеджер ко мне нормально относится а что они могут даже жилье помочь предоставить , а то что с него что то так он сам не работает ему кредит за машину нечем платить он в минусе девочки не бросайте меня я в начале пути чтобы ничего не упустить дайте правильные советы lightlife вам спасибо вы первая откликнулись просто я на этот топик перешла вы мне задавали вопрос в каком я штате Майами Флорида |
